Privacy Policy

This Privacy Policy describes how RetailSight, Inc. ("RetailSight," "we," "us") collects, uses, and shares information when you use our website, mobile applications, and related services (collectively, the "Platform"). RetailSight is a business platform: accounts are provisioned by or on behalf of the retailer, brand, or other organization you work with (your "Organization"), and your use of the Platform is connected to that Organization. Your Organization may have its own privacy policies or notices governing information it collects or makes available through the Platform. RetailSight is not responsible for your Organization's privacy practices.
Your use of the Platform is also subject to our Terms of Service, which contains other binding legal terms. In the event of a conflict between this Privacy Policy and the Terms of Service, the Terms of Service will control except with respect to matters specifically addressed by this Privacy Policy.
1. Information We Collect.
1.1 Account information. When your Organization invites you, we receive your email address and, optionally, your name. We store credentials securely through our authentication provider and never store your password in plain text.
1.2 Organization and role information. We maintain records of the Organization you belong to, your role within it, and the stores or product lines you are assigned to.
1.3 Content you capture. The core function of the mobile app is scanning retail environments. When you perform a scan, we collect the photos or videos you capture (for example, images of store shelving, bays, products, and price tags), along with related scan data such as the store you selected, timestamps, detected products and prices, and notes you add. Captured imagery is intended to depict retail fixtures and merchandise only; you shall not intentionally capture images of individuals in your scans, and RetailSight is not responsible for any personal information inadvertently included in scan imagery.
1.4 Device and usage information. We collect technical information needed to operate and improve the Platform, such as device model, operating system version, app version, diagnostic logs, and how you use Platform features. We may also use cookies, local storage, and similar technologies on our website to support authentication, remember preferences, and analyze usage patterns.
1.5 What we do not currently collect. The mobile app does not currently request or track your device's GPS location. Store associations are chosen by you or assigned by your Organization. We do not collect information for third-party advertising.
2. How We Use Information.
2.1 We use collected information : (a) To operate the Platform, including processing scans into shelf, pricing, and inventory insights; (b) To make scan results and analytics available to you and your Organization; (c) To operate, maintain, and improve our detection and analysis models and the quality of scan results, including through the creation and use of aggregate, de-identified, or anonymized data derived from Platform activity; (d) To provide support, send service communications (such as invites and security notices), and keep accounts secure; (e) To develop new features, products, and services and to improve existing ones; (f) To enforce our Terms of Service and other agreements; and (g) To monitor for fraud, abuse, and technical issues, and to comply with legal obligations.
3. How Information Is Shared.
3.1 With your Organization. Scans, captured imagery, and related activity are visible to your Organization and its authorized administrators. Your Organization controls who has access to its workspace. RetailSight does not control and is not responsible for how your Organization uses, shares, or retains information available to it through the Platform.
3.2 With Service Providers. We use third-party providers to run the Platform — cloud hosting and storage, database and authentication infrastructure, email delivery, and mobile build and update infrastructure. These providers process information only to provide services to us and are subject to contractual obligations regarding confidentiality and data protection.
3.3 For Legal Reasons. We may disclose information if required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is reasonably necessary to protect the rights, safety, or property of RetailSight, our users, or others, to investigate or prevent fraud or other illegal activity, or to enforce our agreements.
3.4 In Connection with a Business Transaction. If RetailSight is involved in a merger, acquisition, reorganization, sale of assets, or similar transaction, information collected under this Privacy Policy may be transferred as part of that transaction. If such a transaction results in a material change to the handling of information covered by this Privacy Policy, we will update this Privacy Policy in accordance with Section 8.
3.5 Third-party Links and Services. The Platform may contain links to websites or services operated by third parties. RetailSight does not control and is not responsible for the privacy practices or content of those third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.
3.6 We do not sell personal information, as defined under applicable law, and we do not share personal information with third parties for advertising. We may use and disclose aggregate, de-identified, or anonymized information that does not identify any individual for any business purpose, including analytics, benchmarking, and product improvement, and such information is not subject to this Privacy Policy.
4. Data Retention.
4.1 We retain account information for as long as your account is active and as needed to provide the Platform to your Organization. Following account deactivation or termination, we may retain certain account information for a reasonable period to fulfill the purposes described in this Privacy Policy. Scan content is retained under the direction of your Organization. We may retain certain information as required by law or for legitimate business purposes such as security, audit records, dispute resolution, and enforcement of our agreements. Retention periods may vary based on the nature of the information and the purposes for which it is used. For clarity, aggregate, de-identified, or anonymized information is not subject to the retention limitations in this section and may be retained and used indefinitely.
5. Security.
5.1 We use commercially reasonable administrative, technical, and physical safeguards designed to protect information, including encrypted transport, scoped access controls, and role-based permissions. No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your credentials and for notifying us promptly of any suspected unauthorized access.
6. Your Choices.
6.1 Camera and microphone access are controlled through your device settings and are used only for scanning features. Disabling camera access may prevent you from using certain scanning functionality of the Platform.
6.2 You can update your display name and password in the app or on the web.
6.3 To access, correct, or delete information associated with your account, contact your Organization's administrator or reach us via the contact page below. Some requests may be fulfilled by your Organization, which controls its workspace data. Deletion of scan content and related data is subject to your Organization's direction and retention requirements. We will respond to requests in accordance with applicable law and may decline requests where permitted by law, including where fulfilling a request would be unreasonably burdensome, infringe on the rights of others, or conflict with our legal obligations.
7. Protection of Minors.
7.1 The Platform is intended for business use by working adults and is not intended for persons under 18. We do not knowingly collect personal information from persons under 18. If we learn that we have collected personal information from a child under 16, we will take steps to delete that information promptly.
8. Changes to This Policy.
8.1 We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice (within the Platform or by email). Posting the revised Privacy Policy on our website constitutes sufficient notice of any changes. Your continued use of the Platform after any update constitutes your acceptance of the revised Privacy Policy.
